Professors Raleigh Levine and Mehmet Konar-Steenberg will provide an overview and statistics about the October 2016 Term, and review important U.S. Supreme Court cases decided during the last session, including precedents set, constitutional rights curtailed and expanded, and other cases of note.

The Mitchell Hamline School of Law History Center presents the inaugural lecture of the Edward J. Devitt Chair and the first in its series of Minnesota Legal Legends.

Federal Judge Edward J. Devitt had a significant impact on legal education, on the practice of law, and on the federal judiciary, both in Minnesota and nationally.

The program will consist of four panel discussions regarding:

The Many Lives of Edward J. Devitt - panel speakers are Greg Stenmoe `81 and Brian Short.
Judge Devitt's Contributions to Professional Excellence in Federal Lawyering and the Movement for Practical Training in Law Schools - panel speakers are Prof. Eric Janus, Daniel O'Keefe `78 and Prof. Ann Juergens.
Judge Devitt and Professionalism in Judicial Administration - panel speakers are Justice Wilhelmina Wright, Judge Donald Alsop and Prof. Emeritus Peter N. Thompson.
Judge Devitt and the Criminal Trial - panel speakers are Joseph Friedberg, Earl Gray `70 and Judge Ann Montgomery.

The IP Institute at Mitchell Hamline School of Law (MHSL) is happy to sponsor a continuing legal education event (CLE) on October 12, 2017, featuring the leading expert on rights of publicity, Professor Jennifer Rothman. The event will begin with a talk by Professor Rothman concerning her forthcoming book, The Right of Publicity: Privacy Reimagined for a Public World, to be published by Harvard University Press. Professor Rothman’s presentation will be followed by a panel discussion, “Legislating Mortality: The Law and Policy of Post-Mortem Publicity Rights”, moderated by local art & entertainment lawyer (and MHSL alum), Walter Lehmann. The CLE program will be in the Conservatory with the reception in the Armstrong Great Room.

Why is Minnesota Removing so Many Children into the Child Protection System: A Critical Look at the Removal Process in Minnesota Mitchell Hamline School of Law presents a CLE and continuing education credit conference addressing Minnesota’s removal processes. The presentation will focus on current social science research related to the experience of children during the removal process. We also plan to present a comprehensive overview of Minnesota’s removal data, including a focus on short stayers in the system (children who are removed and then returned within 30 days). Panelists and expert speakers from around the county will discuss best practices for child-centered removal. Further, Minnesota’s removal hearings will be discussed in detail including the law, current practices, and examples of national models for best practice at removal hearings. There will be time at the end of the day for interactive discussion among stakeholders as to how Minnesota could improve its removal processes and hearings. This event is recommended for judges, attorneys, child protection workers, children’s attorneys, and guardians ad litem. The cost will be $75 and a $25 discounted rate will be offered for public interest attorneys and staff using the CPP discount code. Lunch will be provided with cost of entry. CLE Credits pending. CLE Event time is 9:00 am to 4:00 pm with a networking reception after.
Alumni CLE: Buffer Law Basics: Application, Implementation, and Potential Constitutional Questions

The Alumni CLE Series presents "Buffer Law Basics: Application, Implementation, and Potential Constitutional Questions"

This CLE will focus on Minnesota’s 2015 Riparian Protection and Water Quality Practices Law—the so-called Buffer Law. The CLE will first discuss where the law applies, particularly what types of waters are subject to the buffer law and what exceptions apply. Next, the CLE will cover what must be done to implement and comply with the law, including deadlines, what constitutes a sufficient buffer strip, and what types of alternative practices might be put in place. Finally, the CLE will discuss potential constitutional issues facing the buffer law. 

Presenter Dean Zimmerli '14 (HUSL) is an attorney with Gislason & Hunter in New Ulm, MN. Dean focuses his practice on civil litigation and business issues including agriculture law, banking, corporate and employment law. Dean acquired a valuable work ethic growing up on a farm in rural Minnesota as well as a full understanding of agri-business issues. He provides service to his clients addressing their full range of legal needs through conducting research, drafting agreements and collaboration with other Gislason & Hunter LLP attorneys in contract negotiations, business growth ventures and financial strategies.

Every two minutes someone is sexually assaulted in the United States, yet hundreds of thousands of rape kits collected from these assaults sit untested in storage facilities across the country, with close to 4,000 of them in Minnesota.

 

Nearly 250,000 underage U.S. girls were married between 2000 and 2010. Many child marriages occur to avoid statutory rape laws or to protect rapists.

 

Ellen Kennedy, Ph.D., Executive Director of World Without Genocide, and Caroline Palmer, J.D., Public and Legal Affairs Manager of the Minnesota Coalition Against Sexual Assault, will discuss rape kit reform, child marriage, and current legislative efforts to enhance prosecutions for sexual violence.

 

Open to the public; no reservations are necessary. $10 general public, $5 students and seniors, and free to Mitchell Hamline students. 2 ‘clock hours’ for educators and $25 for two standard CLE credits for lawyers.

 

Co-sponsored by Forward Global Women and the Minnesota Coalition Against Sexual Assault.

The Alumni CLE Series presents "The Constitutionality of the Minnesota Sex Offender Program"

Professor Eric Janus, who was appointed as a member of the State of Minnesota’s Sex Offender Civil Commitment Advisory Task Force, and who has written several books on sexual predator and civil commitment laws, will provide an update on the history and current status of the Karsjens v. Piper litigation, which challenges the constitutionality of the Minnesota Sex Offender Program. In addition, Professor Janus will present an analysis of the issues presented to the U.S. Supreme Court in the plaintiffs’ petition for certiorari following the U.S Circuit Court of Appeal for the Eight Circuit’s reversal of the U.S. District Court for the District of Minnesota’s ruling that the program was unconstitutional.

When No one is Behind the Wheel: Liability and Other Legal Issues Surrounding the Development of Driverless Cars

Professor Prince examines the various legal implications of the development of autonomous cars, including in the areas of accident liability, insurance, and regulatory law. Professor Prince explores the concept that driverless cars will be a truly disruptive technology for certain law practices, especially plaintiff's and insurance defense lawyers who litigate car crashes. If drivers are no longer at fault for most car accidents, what will happen to these practices?

Cost: $30 to watch this previously recorded CLE via webcast. Free for graduates from the last two years, graduates who are on active military duty or are veterans, current students, faculty (including adjuncts), and staff. To register to attend for free, email Cathy.Englin@mitchellhamline.edu.
