Super CLE Week: Constitutional Issues Regarding the Trump Executive Orders

"Constitutional Issues Regarding the Trump Executive Orders."


During his first year in office, President Trump issued, or has been responsible for, four executive orders that have drawn significant public attention:  the travel ban, the sanctuary jurisdictions order, the transgender military exclusion, and the DACA repeal.  Each operates within its own subject-matter area, and each has raised a distinct set of constitutional issues.  The travel ban has been interpreted by reviewing courts as presenting Establishment Clause issues, the sanctuary jurisdiction order raises 10th Amendment issues, the transgender military exclusion raises equal protection issues regarding sexual orientation and identity, and the DACA repeal raises due process questions, as well as equal protection issues regarding ethnicity and national origin.  The presentation will address how courts have dealt with each of these issues, and suggest some unifying and concluding legal themes. The presentation will also feature appropriate opportunities for questions and answers with the participants.

Professor Anthony S. Winer

Presenter Biography:

Professor Winer teaches Constitutional Law, International Law, and other subjects related to each, at Mitchell Hamline, where he has been on the faculty for 27 years.  He was the first full-time law professor in Minnesota to teach a course in Law and Sexuality as part of the regular recurring curriculum.  He was one of the initial organizers of the Minnesota Lavender Bar Association, and was for several years a member of its board of directors.  During the era of “Don’t Ask Don’t Tell” restrictions on military service, he regularly spearheaded the efforts of the former William Mitchell College of Law to assure appropriate institutional responses to potentially discriminatory recruiting on campus.  He had a supervisory role in the legal work that supported the legislative repeal of Minnesota’s ban against same-sex marriage. 

He is the author of two books on International Law research, and has published numerous book chapters and articles on international law and constitutional law issues.  Many of his publications have concerned the law regarding LGBT persons.  He won the 2014 Annual Global Legal Skills Book Award for the publication of his textbook, International Law Legal Research.
