On January 25, 2018, Mitchell Hamline School of Law (MHSL) will present a continuing education program for lawyers and social workers on the subject of human trafficking, focusing on the critical role that they play in both identifying and preventing sex and labor trafficking. Consistent with the resolutions by the American Bar Association noted above, the panels will both address ethical obligations of lawyers. 2.0 ETHICS CLE credits have been approved by the Minnesota Board of CLE. Schedule: 3:30 to 4:00: Registration 4:00 to 4:05: Welcome and introductions, Professor Sharon K. Sandeen 4:05 to 5:05: Panel #1: Moderated by Gloria Contreras-Edin The first panel will provide insights on how victims of human trafficking are recruited and how to identify human trafficking victims. 1. Lisl Zamora, Attorney, Contreras Edin & Associates, P.A. Attorney and advocate for immigration and human trafficking victims. 2. Linda Miller, founder of Civil Society 3. Human Trafficking Survivor (TBD) 5:05 to 5:15: Break 5:15 to 6:15: Panel #2: Moderated by Dean Dena Sonbol, MHSL The second panel will discuss the local resources that are available to assist human trafficking victims and how attorneys and social workers might utilize those resources to address problems that they encounter. All panelists will provide insights about how best to communicate with victims of human trafficking. 1. Dave Pinto, Minnesota legislator and Ramsey County Attorney focusing on juvenile sex trafficking. 2. Lauren Ryan, Safe Harbor Minnesota, Department of Health. 3. Kristi Jarvas, Sexual Assault Resource Service, Hennepin County Medical Center. Nonprofits that aid and assist human trafficking victims are invited to table at this event. Civil Forfeiture in Minnesota

This presentation will discuss the expanding issue of civil forfeiture in the United States and Minnesota.

Americans threatened with civil forfeiture face an appalling lack of due process that treats property owners worse than criminals:

Profit Incentive: In 43 states, police and prosecutors can keep anywhere from half to all of the proceeds they take in from civil forfeiture—a clear incentive to police for profit.

Equitable Sharing: Under a federal program called “equitable sharing,” local and state law enforcement can bypass state laws that limit civil forfeiture. By collaborating with a federal agency, they can move to forfeit property under federal law and take up to 80 percent of what the property is worth. Granting law enforcement a direct financial stake in forfeiture encourages profiteering and not the pursuit of justice.

Burden of Proof: Nearly all states and the federal government require far less evidence than the “beyond a reasonable doubt” standard for criminal convictions.

Guilty Until Proven Innocent: While many civil forfeiture laws do have a process for innocent owners to reclaim their property, all too often the burden of proof is on the owner—not the government. Therefore, under civil forfeiture, property owners have to prove their innocence and show that they were not aware of any criminal activity.

Limited parking is available in the Summit Church parking lot on Victoria just north of Summit, and in Mitchell Hamline’s overflow parking lot at Grotto and Summit, about 2 blocks east of the law school on Summit Avenue. There are also a handful of visitor spots in Mitchell Hamline’s main parking lot on the corner of Victoria and Summit along the Summit (South) side, as well as street parking. Do not park in spaces not marked for visitors as those are permit-only.

Convicting Sex Traffickers: Minnesota Law versus Federal Law

This event will feature three panels and a keynote speaker discussing the difference in convictions that traffickers receive. Some are convicted under federal law and some under state law. Speakers will discuss how they'd like to see the laws change, the evidence needed from law enforcement in the court system, and what they have learned by working with victims or observing in court. 

A light breakfast, lunch, and snacks will be provided. The event will also be available for CLE credit. The Mitchell Hamline Journal of Public Policy and Law Symposium is hosting this event.

The Alumni CLE Series presents: "Pet Law: A New Practice Area Unfolds"

Presenter Barbara J. Gislason ’80 (WMCL), of the Law Office of Barbara J. Gislason will provide an overview of animal law nationally and internationally, and focus on three leading national cases and three cases of importance in Minnesota.

Barbara is a solo practitioner in Fridley, Minnesota, offering experienced legal guidance, practical solutions, and aggressive advocacy across a diverse range of legal areas, including Family Law, Animal Law and Intellectual Property Law. She has worked with national and state associations to create Animal Law committees and has been instrumental in drafting and passing laws regarding animal issues. She has extensive experience representing clients involved in animal-related disputes, and continues to play a key role in national efforts to standardize and mainstream Animal Law as a legal practice area.

She is the author of Pet Law and Custody: Establishing a Worthy and Equitable Jurisprudence for the Evolving Family, which Temple Grandin called “[e]ssential reading for lawyers and anybody who is interested in animal legal issues. Barbara Gislason’s work is pioneering and will help you think deeply about the relationship between people and animals.”

"Script from Within" is a collaborative visual art project that incorporates authentic handwritings of women who are incarcerated in Minnesota, confronting viewers with the humanity behind mass incarceration of women. The rate of incarceration of women in our state has increased over 900% in the past three decades.

The gallery exhibit runs from Jan. 10 to Feb. 28 in the Mitchell Hamline School of Law art gallery. 
Marcia Haffmans is a fiscal year 2017 recipient of an Artist Initiative grant from the Minnesota State Arts Board.

This event is free and open to the public. Registration is not required.

When No one is Behind the Wheel: Liability and Other Legal Issues Surrounding the Development of Driverless Cars

Professor Prince examines the various legal implications of the development of autonomous cars, including in the areas of accident liability, insurance, and regulatory law. Professor Prince explores the concept that driverless cars will be a truly disruptive technology for certain law practices, especially plaintiff's and insurance defense lawyers who litigate car crashes. If drivers are no longer at fault for most car accidents, what will happen to these practices?
